Ensuring law and order, protection of values and social relationships from criminal attempts and guaranteeing inviolability of these values form the minimal basis that is necessary for the existence of the societal stability. At the same time, these are elements, which have to be realized by the state by means of its competent authorities.The democratic form of government,  besides its representative nature, is also characterized by the main stress put on the personality  of the human being and the observance of human rights and freedoms.The  special investigation activity, being a specific tool, is frequently arousing an ambiguous reaction from the part of citizens. It is considered that by carrying on this activity violations of human rights and freedoms are committed, as it is assumed that some provisions of the legal acts governing the special investigation activity are unconstitutional.Though, by way of special investigation activity several important tasks can be accomplished with a view of ensuring the observance of the law in our society, the particular nature of special  investigation measures consists in their intrusiveness into the private life of individuals.Therefore, the above-mentioned activity has to be regulated in detail with a view of avoiding abuses or misuses of power in the process of its accomplishment. 

Asigurarea ordinii de drept, protejarea valorilor şi relaţiilor sociale de atentatele criminale şi garantarea  intangibilităţii acestora constituie baza minim necesară pentru existenţa stabilităţii în societate, fiind concomitent şi elemente care urmează a fi realizate de către stat prin intermediul organelor abilitate. Sistemul democratic de guvernare a statului, în afară de caracterul reprezentativ al acestuia, se mai caracterizează şi prin plasarea accentului principal pe personalitatea umană, respectarea drepturilor şi libertăţilor acesteia.Activitatea specială de investigaţii, fiind un instrument specific, frecvent trezeşte la cetăţeni o reacţie neunivocă, deoarece se consideră că prin efectuarea acesteia sunt încălcate drepturile şi libertăţile lor, presupunînd că unele dispoziţii ale actelor normative care reglementează activitatea specială de investigaţii sunt neconstituţionale.
