The idea to respect the purpose subjective right is clear from art.55 of the Moldovan Constitution, which disputes that „Any person exercising constitutional rights and freedoms in good faith without infringing the rights and freedoms of others“. Abuse of rights theory was developed first in civil law. Starting from the reality that civil law regulates the relations of property and nonproperty established between individuals and legal persons on an equal legal footing and that these rights can be exercised in violation of limits outlined according to their economic and social order, legal literature of speciality treated this subject in contents of many works. |

Teoria abuzului de drept a fost dezvoltată la început în materia dreptului civil.
