Rezumat

Research in organizational system of justice in different states in the last period leans toward the assertion that the power, including at the actual stage of society development, intends to control the judiciary through various latent leverages for affirmation of an inequality between the state and the citizen, the State being represented by officials. This context rises to some questions that need the answers regarding: the conditions of affirmation of democracy, the quality of the justice, the dialectic between the state and the role of law and justice in the field, the efficiency of justice in contemporary society. Namely, the strengthened capacity on justice is the best to improve these trends, and highlight the opportunities of consolidation process of justice in achieving a contemporary democratic regime.
