Наразі в Україні норми галузі адміністративного права про охорону здоров’я кодифіковано у двох законах – Кодексі України про адміністративні правопорушення й Основах законодавства України про охорону здоров’я. Що ж до Кодексу адміністративного судочинства України (ще одного кодифікованого акта галузі адміністративного права), то він не має безпосереднього стосунку до законодавства про охорону здоров’я. Основи законодавства України про охорону здоров’я виступають як міжгалузевий акт кодифікованого характеру, у якому здійснено предметну кодифікацію норм про охорону здоров’я, а Кодекс України про адміністративні правопорушення є актом кодифікованого характеру галузі адміністративного права. В останньому акті запропоновано змінити найменування глави 5 на «Адміністративні порушення в галузі охорони здоров’я населення й праці», відповідно змінивши й порядок розміщення статей (спочатку статті про порушення в галузі охорони здоров’я населення, а після них – статті про порушення в галузі охорони праці). Пропозиція аргументована тим, що коло ймовірних потерпілих від правопорушень у галузі охорони здоров’я населення є потенційно значно більшим, ніж від правопорушень у галузі охорони праці.

Currently, the norms of the administrative law on health protection in Ukraine are codified in two laws – the Code of Ukraine on Administrative Offenses and the Fundamentals of the Ukrainian Legislation on Health Care. As for the Code of Administrative Justice of Ukraine, another act of a codified nature of the field of administrative law, it has no direct relation to the legislation on health care. The fundamentals of Ukrainian health legislation act as an interdisciplinary act of a codified nature, in which substantive codification of health norms has been made, and the Code of Administrative Offenses of Ukraine is an act of a codified nature of the field of administrative law. The last act proposed to change the title of Chapter 5 to “Administrative violations in the field of health protection of the population and labor”, respectively, changing the procedure for posting articles (first articles on violations in the field of public health, followed by articles on violations in the industry labor protection). The proposal is based on the fact that the range of probable victims of human health violations is potentially much larger than that of occupational safety and health violations.
