Стаття присвячена висвітленню актуальної проблеми щодо визначення механізму реалізації конституційного права особи на охорону здоров’я за законодавством зарубіжних країн. Автором сформульоване поняття механізму забезпечення реалізації конституційного права особи на охорону здоров’я; визначені та охарактеризовані елементи означеного механіз­му відповідно до конституційного законодавства зарубіжних держав. На підставі проведеного аналізу наукової літератури та законодавства деяких зарубіжних країн сформульовано ряд висновків стосовно особливостей механізму реалізації конституційного права на охорону здоров’я у порівнянні з аналогічним механізмом, що діє в Україні.

The article is devoted to the coverage of the actual problem in determining the mechanism of implementation of the constitutional right of a person to health according to the legislation of foreign countries. The author formulates the concept of mechanism for ensuring the implementation of the constitutional right of a person to health; defined and characterized elements of the said mechanism in accordance with the constitutional legislation of foreign countries. Based on the analysis of scientific literature and legislation of some foreign countries, a number of conclusions were drawn regarding the peculiarities of the mechanism for the implementation of the constitutional right to health protection in comparison with the similar mechanism in force in Ukraine
