| Rezumat | ||||||
This study is dedicated to the analysis of the punishments established by the legislator for the manipulation of an event and arranged betting offences (art.2421 and 2422 of the Criminal Code). It is concluded that the positioning of the pecuniary punishment in the first place in art.2421 and art.2422 of the Criminal Code suggests to the judges that the alternatives available to the detention should be taken into consideration. It is stated that the imprisonment penalty should be applied as a last resort. It is also underlined that the penalty in the form of deprivation of the right to hold certain positions or to practice certain activities has a limited scope, namely: only in those hypotheses in which the perpetrator has made use of his or her job or the activity he carries out in committing the offense of manipulating an event. Nevertheless, there is a legislative inadvertence and an appropriate solution is proposed. |
