Analyzing the text of article 40 of the Law no. 178 of 25.07.2014 on Disciplinary responsibility of judges in conjunction with the provisions in the articles 21, par. (5), 24 and 25 of the Superior Council of Magistracy Law, it has been observed that the appeal against the SCM judgment is the only procedure of judgment prescribed by the law and that this procedure of appeal does not ensure the judge on whom a disciplinary action is imposed only limited access to a lawsuit. Judgment on applying disciplinary action to a judge is pronounced by the SCM and is not equivalent to a judicial process, given that the examination of a disciplinary case by the authority exercising judicial self-administration does not represent a trial in court – this conclusion results from the requirements of the principle of separation of powers in a State, which in the relationship between the jurisdictional administrative authority and the judicial authority, rules out the possibility of SCM’s substitution for the work of the court. Following the considerations revealed in this article, opting for compatibility of regulations subject to this analysis with the standards imposed by the Constitution and ECHR and Fundamental Freedoms, we advocate for developing and adopting a set of new modern guarantees and legislative tools, that would ensure that the restorative and sanctioning justice functions shall be exercised within a framework of legality and equality, thus removing the limitation of the right of a judge to a free access to justice if it the judgment on applying disciplinary action is contested. |
