Within performed study is analyzed illegal carrying, storing and purchasing of firearms (except smooth-bore hunting weapon) or ammunition as normative modalities of expressing penal illicit referred to art.290 PC RM. It states that to be in the presence of illegal carrying of firearm and ammunition is sufficient one movement with those objects from one place to another. Storing and purchasing of firearms (except smooth-bore hunting weapon) or ammunition may take the form of action and inaction. The firearm illegally possessed used to commit an offense exceeds the content of objective side of the offense specified in art.290 PC RM which is why, in assessing those committed will make use qualifying rules according to accumulation of offenses. It argues that taking into possession of firearms or ammunition who was found is one of the forms of illegal purchase, while taking into possession of objects through their theft, is not illegal purchase.
