The article is devoted to establishing the content of the subjective side of the bribery of the enterprise, institution or organization in Ukraine. The legal relationships that provide a compliance with the regulatory procedure of the citizen’s rights and freedoms’ realization in the terms of relations with enterprises, institutions or organizations are explored. Court practice concerning receiving (giving) illegal benefit is analyzed.

Стаття присвячена з’ясуванню змісту суб’єктивної сторони підкупу підприємства, установи чи організації в Україні. Досліджуються загальнотеоретичні питання суб’єктивної сторони як елементу складу злочину, її ознак: вини, мотиву та цілі. На ґрунті доктринальних підходів формується позиція щодо суб’єктивної сторони підкупу працівника підприємства, установи чи організації як у активній, так і у пасивній формах.
