The article examines the history of the germination of the basic principles of international law in the ancient period. The author examines the influence of the main features of the ancient period to the formation of the basic principles of international law. The basic principles of international law are formed in the pre-state period of international law under the influence of the pyramidal structure of social relations in order to establish an international balance in the most important economic, political and cultural relations of the international legal nature. The author prove that the general principles of international law could not be formed in the pre-classical period, as there was already an active international cooperation (ibi societas ibi jus). Preclassic principles of international law are natural and legal origin, and therefore survived the period of its germination and became the normative basis of modern international.

У статті досліджується історія зародження основних принципів міжнародного права у стародавній період. Автор розглядає вплив основних особливостей стародавнього періоду на становлення основних принципів міжнародного права в якості природно-правових, суспільно-необхідних норм, що мали яскраве релігійне забарвлення. Доводиться, що загальні принципи міжнародного права не могли не сформуватися в докласичний період, оскільки тоді вже існувала активна міжнародна взаємодія (ibi societas ibi jus). Принципи докласичного міжнародного права мають природно-правове походження, а тому пережили період свого зародження та стали нормативного каркасом сучасного міжнародного права.
