<description xml:lang='ru' descriptionType='Abstract'>В статье исследуются актуальные вопросы реализации законного представительства опекунами согласно положениям действующего гражданского и семейного законодательства Украины. Анализируются соответствующие судебные решения и правовая доктрина. Рассматриваются законодательные ограничения (пределы полномочий) представительской деятельности опекуна в отношении имущественных прав и интересов подопечного. Отдельное внимание уделяется проблемам установления и реализации опекунства над имуществом недееспособного или безвестно отсутствующего лица. Обосновывается вывод о направленности представительских полномочий опекуна малолетнего и недееспособного лица, прежде всего на процессуальную и имущественную сферы. </description>
<description xml:lang='en' descriptionType='Abstract'>The article examines current issues of the implementation of legal representation by guardiansaccording to the provisions of existing civil and family legislation of Ukraine. Analyzes relevant case law and legal doctrine. Considers the legal restrictions (limits of authority) ofguardian’s representation activity in respect of property rights and interests of the ward. Special attention is paid to the establishment and implementation of guardianship over the property of an incapacitated or missing person. Substantiates the conclusion about the execution direction of representative powers of the guardian of a minor and incapacitated person, primarily on procedural and property spheres.  </description>
