В статье проводится теоретическое исследование способов защиты права на врачебную тайну. Осуществлен анализ научных трудов, в которых исследуются вопросы способов защиты права на врачебную тайну. На основе анализа судебной практики сделан вывод, что способы защиты права на врачебную тайну зависят от вида нарушения права на защиту врачебной тайны. Основными способами, которые могут быть использованы при защите прав на врачебную тайну, является признание незаконными решений, действий или бездеятельности органа государственной власти, органа власти Автономной Республики Крым или органа местного самоуправления, их должностных и служебных лиц, и возмещение причиненного ущерба.

The article presents a theoretical study of methods of protection of the right to medical confidentiality. The analysis of scientific works in which examines the issues of methods of protection of the right to medical confidentiality. Based on the analysis of judicial practice, we can conclude that the methods of protection of the right to medical confidentiality depend on the type of violation of the right to protection of medical confidentiality. The main methods that can be used in the protection of patient confidentiality is the recognition of the illegal decisions, actions or inaction of public authority, authority Autonomous Republic of Crimea or body of local self-government, their officials and officers and compensation of the caused damage.
