У статті аналізується механізм авторсько-правової охорони комп’ютерних програм відповідно до зобов’язань Угоди про торговельні аспекти прав інтелектуальної власності (ТРІПС) Світової організації торгівлі. Звернено увагу на критерії охороноздатності програми, перелік ексклюзивних прав, якими сторони зобов’язуються наділити авторів програм, систему заходів з охорони зазначених прав. Окреслюються також інші особливості угоди, що дозволяють говорити про її ефективність в аналізованій сфері. Водночас розглядаються також елементи ТРІПС, щодо яких можливі вдосконалення. Пропонується проведення відповідних досліджень, розробок.

The paper analyses the mechanism of copyright protection of computer programs in accordance with the obligations of the World Trade Organization Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). Attention is drawn towards the criteria of protect ability of computer programs, the list of exclusive rights that the parties to the agreement are obliged to grant to the authors of programs, the system of measures of protection of said rights. Other features of the agreement that allow to state its effectiveness in the researched area are also underlined. At the same time, the author notes several elements of TRIPS that could be improved and proposes the conduct of respective studies.
