A crime shall be considered as being committed with intent if the person who committed it realized the prejudicial nature of his/her action or inaction, foresaw its prejudicial consequences, and wanted or consciously admitted the occurrence of such consequences. The intent is the fundamental, general and original form of the guilt. Generally, most crimes are committed with intent and only exceptionally, with imprudence or with two forms of guilt. Establishing the correct type of the intent is particularly important to individualize the criminal liability and punishment. Thus, the prejudicial measure of the direct intent is much higher than that of indirect intent, and the premeditated intent higher than the spontaneous intent.
