According to the principle of legality of criminal offenses and punishment, a concrete action can not attract criminal liability only if it is provided as a criminal offense by a rule. Provision crime by the criminal law is the first condition of existence of any crime. It follows from the principle of legality of criminal offenses, such that in the absence of this condition, the act does not constitute infringement. Correspondence between concrete and abstract model scene features (type) according to the norms of criminality, is known in the literature as the typicality. The legality of criminal offenses and punishment appears as one of the most important limitations of jus puniendi, it represents the main guarantee of legal security of the citizen to the criminal law. This goal necessarily implies security for any person to know, before committing, acts that constitute offenses and penalties for their commission. Romanian law, the principle of legality has acquired legal force constitutional. According to the doctrine, the principle of legality has direct practical consequences both in the elaboration of legal rules and their application process une imperative at all follow some of them.
