Rezumat

In this publication, I addressed issues related to realization of the law by application by the state bodies, having the European integration vector. We cannot talk about a legal norm as a whole, confining ourselves only to its creation; there is a need to transpose it in life, in order to achieve the purposes and goals. We cannot overlook the requirements underlying the establishment of the rule of law in Moldova, which aligns the process of making law enforcement. The establishment of the law state takes place by the law enforcement.

În această publicaţie am abordat aspecte ce ţin de realizarea dreptului prin aplicare de către organele statului, avînd drept vector procesul de integrare europeană. Nu se poate vorbi despre o normă juridică în ansamblu, limitîndu-ne la procesul de creare, mai este nevoie şi de o transpunere a ei în viaţă, ca norma să-şi atingă scopul care şi l-a propus. Nu putem trece cu vederea nici exigenţele care stau la baza constituirii statului de drept în Republica Moldova, care se aliniază procesului de realizare a dreptului prin aplicare; constituirea statului de drept are loc, inclusiv prin intermediul aplicării dreptului.
