<cfAbstr cfLangCode='RU' cfTrans='o'>В статье проводится теоретическое исследование предмета доказывания по спорам, возникающим из наследственных правоотношений. Раскрываются элементы предмета доказывания по отдельным наследственным спорам. Обоснован вывод о необходимости выделения двух групп обстоятельств, формирующих предмет доказывания по исследуемой категории гражданских дел – обязательных и факультативных. К обязательным относятся такие обстоятельства, которые подлежат установлению по всем наследственным спорам: факт открытия наследства; место открытия наследства; наличие или отсутствие завещания; круг лиц, призываемых к наследованию. Факультативные факты предмета доказывания зависят от конкретного спора, возникающего из наследственных правоотношений. Как правило, такие обстоятельства закреплены в соответствующих нормах материального права, подлежащих применению к спорным отношениям, которые возникли между сторонами. </cfAbstr>
<cfAbstr cfLangCode='EN' cfTrans='o'>The article conducts a theoretical study of the subject of proof in disputes arising from inheritance relationships. Elements of the subject of proving in individual succession disputes are disclosed. The conclusion regarding the necessity of providing of two groups of circumstances that form the subject of proof in the studied category of civil cases – mandatory and optional is given. Mandatory includes such circumstances to be determined on all inheritance disputes: the fact of opening of the inheritance; the place of opening the inheritance; the presence or absence of a will; the persons called for the inheritance. Optional facts of a subject of proof depend on the particular dispute arising from the inheritance relationships. Typically, such circumstances are stipulated in the relevant substantive law to be applied to the contentious relationship that has arisen between the parties.</cfAbstr>
