Obiectul preocupărilor în acest articol îl reprezintă obiectul juridic generic al infracțiunilor de trafic de influență și de cumpărare de influență – infracțiuni prevăzute la art. 326 CP RM. Se analizează opiniile referitoare la conținutul obiectului juridic generic al infracțiunilor de trafic de influență în contextul legii penale autohtone și se compară cu contextul legii penale române, în mare parte având aceeași esență juridică. Sunt prezentate opinii vizavi de obiectul juridic exprimate în literatura de specialitate.

This article is devoted to the investigation of general legal object, generic legal object and to special legal object of the offenses on influence peddling and buying of influence referred to in art.326 PC RM. It is stated that the generic legal object mostly of the offenses specified in Chapter XV of the Special Part of Penal Code of the Republic of Moldova and particularly of the offenses specified in art.326 is formed by the social relationships with regard to the effective activity in the public sphere. Also, it is concluded that the special legal object of the offence under par.(1) art.326 PC RM is formed by social relationships with regard to the duties of the public bodies, dignitaries, public foreign figures and of the international civil servants. It is pointed out that those duties are incompatible with the suspicion on lobbying of the decision makers by a person with influence. It is shown that the special legal object of the offense on buying of influence has other content than the special legal object of the offence on influence peddling.
