In the present investigation work, it is argued that the victim of sexual harassment offense may be a female or a male person. The victim and the offender may have different or the same gender-sex mem¬bership. The objective part of the offense under art.173 PC RM consists of the prejudicial act formed by the main and adjacent action. The primary act is expressed as a manifestation of a physical, verbal or nonverbal behavior, that violate human dignity or which creates unpleasant, hostile, degrading, humili¬ating or offensive surroundings. In its turn, the adjacent act involves any of the following three ways: a) threat, b) constraint c) blackmail. The primary act of the offense of sexual harassment must meet the following two conditions: to express the manifestation of a physical, verbal or nonverbal behavior; to be perpetrated to the detriment of the victim, namely: a) to harm her dignity or b) to create unpleasant, hostile, degrading, humiliating or insulting surroundings for the victim. |
