In the present study are analyzed the legal-penal implications in the modification of art.174 and 175 PC RM. Among others, there is shown why it was appropriate the modification of art.174 PC RM, forasmuch it brings together the acts of oral penetration, committed against a person who is known to be with certainty under the age of 16 years. There are brought arguments in support of charging the inopportune phrase “perverse acts”, used in the title of article 175 PC RM; there is real danger of confusion with the term “perverse forms to satisfy sexual lust” from art.172 PC RM. It is shown why the title of art.175 PC RM should be rendered as follows: “Sexual corruption of a person under the age of 16 years” |
