The motivation and the purpose of the crime represent psychological factors that cannot be separated from criminal conduct; there for they are indispensable for understanding and explaining this behavior. That’s why our scientific approach is dedicated to determine the role and the juridical content of the purpose and the reason of the false entrepreneurial activity. The achievement of the study allowed us to observe the fact that in contradiction with the goal of the false entrepreneurial activity, objectified in coverage of certain types of illicit business, the motivation of the offence of the 242nd article of the Penal Code of Republic of Moldova, remains to be just an optional sign without a juridical relevance. Also, was demonstrated that through the 242nd article of the Penal Code, the phrase “the covering of illegal types of entrepreneurial activity”, are considered those types of activities which are prohibited by the general law, regardless of category of the legislative act that prohibits particular business.
