The growing interest towards the problem of efficiency of constraint measures with an educational character, applied to minors in the penal law, determines and confirms the necessity of its elucidation. Measures of constraint with an educational character are proposed as an alternative penal punishment. This deliberation of the penal punishment stipulates that the minor can be entrusted to parents, to persons substituting them or to competent state bodies, the objective of the reeducation measure is the correction of minor by means of behavioral participation. There are presented data of diverse periods which denote the inefficiency of the applied sanctions to minors, but also the efficient methods of constraint in other countries. |
