This article aims to analyze the objective side of the offence under par.(1) art.326 PC RM. Among others, it is shown that the methods of claiming, accepting or receiving money, securities, services, privileges, other assets or benefits are alternative methods of the prejudicial act under par.(1) art.326 PC RM. The occurring of any of three alternative methods of the act in question is sufficient for taking in account the application of the liability under par.(1) art.326 PC RM. It is also argued that the offense referred to at par.(1) art.326 PC RM is a formal offense. It is considered consumed starting with the moment of claiming, accepting or receiving money, securities, services, privileges, other assets or benefits.
