Rezumat

The parents’ rights and duties have a personal character being individual for everyone and cannot be transmitted or assigned. Parents’ refusal of their rights and the agreement to adopt children can be fulfilled only according to the existing law. Deprivation or restriction of parental rights can be performed only in court and because of reasons stipulated by law. Giving parents rights regarding their children, legislation requires from them certain obligations, including the obligation to exercise rights for the benefit for both child and society. In this way we can confirm that parents’ rights are at the same time their obligations. Parents bear responsibility for exercising their rights in detriment of their children. Liability arises as a result of illicit acts, carelessness or indiscretion. The main thing is not the parental responsibility, but prevention of ignorance, carelessness, rudeness and abuse in children education. In this way the state, using different means, controls how children are grown up and educated in their families. There may be different methods depending on the character of relations established between parents and children, tutors or other educators and children. The state control aims not only to prosecute guilty parents, but also to help in the difficult problems that appear while educating children.
