In this study, it is shown that by establishing penal liability to legal entities for offences specified in art.325, 326, 334 and 3351 PC RM, we achieved considerably the implementation of the proper international recommendations presented in: art.10 the UN Convention against Transnational Organized Crime; art.26 the UN Convention against Corruption; art.18 the Criminal Law Convention of the Council of Europe on Corruption, etc. It is also concluded that from the provision of par.(3) art.21 PC RM, emerges that the Moldovan legislature used a mixed model of establishing penal liability for legal entities. In this way, we state that the legal entity is liable for the actions of others, which are any of his employees, the body of the legal entity, the representatives of the legal entity. |
