In the present study, among other things, it is concluded that the offense specified at art.2411 PC RM, should be considered as part of the subgroup of offences committed in the domain of entrepreneurship (representing a subgroup of economic offences). It is also revealed that if the act of practicing financial activity without registration is committed as provided by law, art.2411 PC RM, with regard to art.241 PC RM, must be taken in consideration as a special norm. It is proved that the offense referred to at art.2411 PC RM cant have a material object (immaterial object). The material object of this offence are not the funds deposited by participants in the pyramid schemes, circumvented by the one practicing financial activity without registration and authorization as provided by law.
