Problems raised by the application of the new criminal stipulations about dropping punishment of the minor and postponing punishment of the minor. The new Romanian Criminal Cod, applicable starting June,29,2005 adoptied by the Romanian Parliament by low 301/2004 instates new judicial-criminal instititutions and gives special treatment to the institutions of minority, revealing the legislator”s concern for giving the under age delinquent a real chance to social reintegration. In the given context, the paper aims at analysing two new institutions in the field of the system of punishment of the minor namely the dropping of the punishment applicable to the minor-regulated in the article 126 of the new Criminal Cod, and respectively, postponing the application of punishment of the minor, esiding in article 127. |
