Rezumat

The Republic of Moldova proclaimed in the preamble of the Constitution the human dignity as supreme value of the state, and in Article 1.3 stated that the dignity of people represents one of supreme values of a state governed by the rule of law. Therefore, the dignity is considered the basic criterion in the concept of human rights, which is offered to people at birth. In defining the juridical notion of human dignity, it is worth to take into consideration three criteria: human dignity as judicial institution, the inviolability’s guarantee of human dignity, its observance and protection. Basic human rights and liberties are considered guaranties that ensure the human dignity and the value of a right or liberty can be appreciated in the light of the human dignity. The Constitutional Court justified its position on the necessity to protect the human dignity by public authorities in 18 decisions. The grant of the right to direct access of citizens to the Constitutional Court through the constitutional application can play a major role in protecting the human dignity. Regardless the person’s relations with the state power, his dignity comes indisputably within the protection by the state.
