The nowadays problems related to the penal protection of the life of the newborn child are treated in the present article. The off ence of infanticide has a material object, and the special judicial object of this off ence suff ers a touch
even through the agency of the material object. Some aspects with regards to the juridical framing of the off ence of infanticide are analyzed. The opinions of notorious scientists referring to whether the infanticide is an attenuated form of
murder or an off ence by itself, to the application of the theory of the participation allocation in qualifying the off ence of infanticide are presented and debated, and the personal opinions regarding these are explained. |
