This article comprehends other important arguments encouraging the idea on adopting a new explanatory resolution of the Plenum of the Supreme Court of the Republic of Moldova, describing the judicial practice in the penal cases regarding the sexual off ences. Especially, there are intended diff erent solutions on some controversial aspects concerning the qualifi cation of the sexual off ences, inclusively the delimitation from other deeds: the qualifi cation of the act of constraint with the aim of sexual rapport performance, followed by the victim’s decease just before the beginning of the sexual rapport; the delimitation of the off ence of human traffi king, committed throughout rape (lett.g) par.(2) art.165 PC RM), of the off ence of incest (art.201 PC RM), of infantile traffi king, accomponied by violent sexual abuses (lett.b) par.(2) art.206 PC RM), of infantile pornography (art.2081 PC RM), of the off ence of sexual hercelment from the other sexual off ences etc. At the end of the study, there is posted the project of the new explanatory resolution of the Plenum of the Supreme Court of the Republic of Moldova, about the judicial practice in the penal cases regarding the sexual off ences.
