Rezumat

In the present article, some of the aggravating circumstances of the off ences provided for by art.151 and 152 of the Penal Code of the Republic of Moldova are analyzed. Thereby, in the context of the aggravation stipulated in lett.e) par.(2) art.151 and lett.f) par.(2) art.152 PC RM, it’s argued that the notion „by means of rackening or torture” assumes the genuine meaning of extraordinary cruelty. Besides, it is shown that, being isolated from other circumstances, the causation of some multiple wounds can not be considered an expression of rackening or torture by means of which off ences of grave deliberate battery or health harm and of midst deliberate battery or health harm are committed. Hereinafter, there are brought important arguments to ascertain, in accordance with lett.f) par.(2) art.151 and lett.g) par.(2) art.152 PC RM, the fact that the respective aggravating circumstance must accomplish the following conditions: the means, used with a view to produce grave or midst deliberate battery or health harm, should perform a real threat for the life or health of more persons; the off ender must be aware about the dangerousness of the respective means; the off ender must show intention in murdering the aimed victim. Finally, there are examined all the perpetration hypotheses, thereof material interest, of the off ences of grave deliberate battery or health harm and of midst deliberate battery or health harm (lett.g) par.(2) art.151 and lett.h) par.(2) art.152 PC RM).
