In the article the theoretical research is providing on such legal institute of the land law as moratorium on alienation of agricultural lands. The reasons of establishment of moratorium on the sale of agricultural lands are explored. The author analyses normative-legal acts, devoted to the problematic issue in Ukraine, and experience of European countries on this matter. As a result of research the author comes to the conclusion that European market of land based on principles of liberal economy and developed democracy, which are necessary to introduce in Ukrainian civil trade of lands, especially after Association Agreement between the European Union and its member states, of the one part, and Ukraine, of the other part, was signed. Substantiated that the moratorium on alienation of agricultural lands should be immediately abolished, in order to set up in Ukraine competitive and legally functioning market of land. |

Исследуются причины установления моратория на продажу земель сельскохозяйственного назначения; анализируются нормативно-правовые акты, направленные на урегулирование отношений в Украине, а также опыт европейских стран по развитию рынка земли и установлению принципов либеральной экономики и развитой демократии в гражданско-правовом обороте земель. Как следствие, обоснована необходимость отказа от продления моратория на продажу земли сельскохозяйственного назначения с целью установления в Украине конкурентоспособного и легально функционирующего рынка земель (особенно в контексте подписания Украиной Соглашения об ассоциации с ЕС ), а также предложены средства по реализации указанной цели. </description> </descriptions> <formats> <format>application/pdf</format> </formats> </resource>
