Rezumat

It is noted in the article, that one of the priority missions of modern national state is to form healthy nation, in so doing, physical training and sport are primarily intended to promote implementing this mission. The author notes, that from force of inertia, which has lasted since Soviet period of Ukrainian statehood, the area of physical training and sport have been considered to be free from criminal interference, allegedly "untouchable". The given approach causes the lack of proper attention of law enforcement agencies to the state of legal order in this area that has caused nowadays a great multitude of socially dangerous phenomena, particularly "inciting minors to use doping", "gross violation of contest rules" and "bribing the organizers and participants of contests". It has been proven, that mentioned offences, including any other, are being committed when some motives present. The most extended among these offences are so called "shabby offences". The author argues, that a person, harming its life and health while going in for sports, is not facing ajustified risk so long as sportsman, harming its life and health, does not aim to achieve socially useful goal, quite the contrary, the achieved benefit is his personal goal.
