Evidence in civil proceedings is any proofs on which the court determines the presence or absence of circumstances that justify the claims and defenses of the parties and other circumstances relevant to the proper resolution of the case. In accordance with the provisions of the Civil Procedural Code of Ukraine admissible evidence in civil proceedings are: expert opinion; written evidence; material evidence; eyewitness testimony; explanations of the parties, third parties, their representatives questioned as witnesses. This paper presents characteristics and features of evidence in a civil case.
