В статье проводится теоретическое обоснование правовой природы института опеки на основе научных методов исследования. Предложена разработка и принятие единого закона, регулирующего отношения опеки и попечительства и внесение изменений в действующее законодательство, которое будет регулировать основные принципы организации опеки и попечительства на территории Украины, с учетом правовой природы данного института, структуры и довершения законодательства относительно института опеки и попечительства; уделено внимание социальной защите детей-сирот и детей, лишенных родительской опеки.

In article theoretical justification of the legal nature of institute of guardianship on the basis of scientific methods of research is carried out. It is offered development and adoption of the uniform law governing the relations of guardianship and guardianship and modification of the current legislation which will regulate the basic principles of the organization of guardianship and guardianship in the territory of Ukraine, taking into account the legal nature of this institute. structure and legislation completion concerning guardianship and guardianship institute the attention to social protection of orphan children and children deprived of parental guardianship also is paid.
