В статье рассматривается история возникновения и развития наследственного права и зарождения института обязательной доли наследства на территории украинских земель в период Киевской Руси и феодальной раздробленности, что дает возможность проследить трансформацию данных норм до настоящего времени и более точно уяснить смысл и природу института обязательной доли в наследстве. Исследуются основные источники права данного периода, влияние римского права на развитие средневекового украинского права и особенности регулирования наследственных отношений. Отмечено, что государство уделяло определенное внимание охране прав и законных интересов некоторых наиболее социально незащищенных членов семьи при распределении наследственного имущества, что в дальнейшем переросло в законодательно закрепленный институт обязательных наследников и обязательной доли в наследстве.

The article highlights the history and development of inheritance law as well as the emergence of the inheritance obligatory share institution on the territory of the Ukrainian lands in the period of Kievan Rus and feudal division that give the possibility to trace the transformation of those regulations until today and precisely clarify the essence and nature of the inheritance obligatory share institution. The main sources of the law of the given period, the impact of Roman law on the development of medieval Ukrainian law together with the peculiarities of hereditary relationship regulation are researched. It is emphasized that the government paid a particular attention to the protection of rights and legitimate interests of some socially unprotected members of the family in accordance to the sharing of the parental estate that at a later date outgrew in legislative institution of the forced heirs and inheritance obligatory share.
