Rezumat

Raportul dintre legislația naţionala si dreptul internațional este stipulat în Constituţie. Normele unanim recunoscute ale dreptului internaţional devin parte obligatorie a dreptului intern. Majoritatea Constituţiilor multor state europene sunt cuprinse de norme corelate cu legislațiile naționale și dreptul internațional. Si Carta CSI stipulează prioritatea dreptului internațional în sistemul juridic intern. Constituţia Republicii Moldova (art. 8) oferă prioritate standardelor internaţionale, la fel ca şi Republica Belarus (art. 8), Georgia (art. 6), Kazahstan (art. 4), Ucraina (art. 9), Estonia (art. 3) nu permit încheierea şi intrarea în vigoare a tratatelor internaţionale care contravin normelor constituţionale fundamentale. Diferenţele în Constituţiile ţărilor şi documentele de bază a comunităţii internaţionale determină cooperarea internaţională. Această dorinţă de „uniforme juridice” a fiecărui stat cu umanitatea pune in pericol identitatea statelor. Actualmente putem vorbi numai despre o anumită universalitate în procesul integrării.

The relation between national legislation and international law is stipulated in the Constitution. The unanimously approved norms of the international law become an obligatory part of the internal law. The main part of the constitutions in many European states, comprise norms that have been correlated with national legislations and international law. The CIS card also specifies the priority of international law inside the internal legal system. The Constitution of the Republic of Moldova (art. 8) prioritize the international standards, but like in the Republic of Belarus (art. 8), Georgia (art6), Kazakhstan (art. 4), Ukraine (art. 9), Estonia (art. 3) does not allow conclusion and execution of international treaties that come in contradiction with fundamental constitutional norms. The differences in the constitutions of the states and the major documents of the states and the major documents of the international community determine the international cooperation. Взаимоотношение между национальным и международным правом предусмотрено Конституцией. Общепризнанные нормы международного права являются составной частью обязательного закона. В большинстве конституций многих европейских стран действуют правила, связанные с национальным и международным правом. Устав СНГ предусматривает приоритет международного права в рамках национальной правовой системы. Конституционное право (ст. 8) отдает приоритет международным стандартам, это такие страны, как: Республика Беларусь (ст. 8), Грузия (ст. 6), Казахстан (ст. 4), Украина (ст. 9), а также Эстония (ст. 3). Законодательство этих стран не допускает заключения и вступления в силу международных договоров, противоречащих фундаментальным конституционным нормам права. Различия в конституциях разных стран и основных документах государств, а также документов международного сообщества определяет международное сотрудничество. Стремление к «правовой форме» каждого государства в отношении человечества угрожает национальной идентичности государства. В настоящее время мы можем говорить только об относительной универсальности процесса интеграции.
