Transformările actuale din ţările Europei de Est şi din Republica Moldova presupun formarea statului de drept şi a societăţii civile. Acesta e un proces unitar şi complex de funcţionare a unei orînduiri sociale cu orientare democratică. Construirea cu succes a acestui proces depinde în mare măsură de cercetarea amănunţită a fenomenului de „societate civilă”, care din cauze cunoscute era lăsat sub tăcere de către cercetătorii sociali din fostele ţări socialiste. Experiența istorică arată că nici un model al societății civile este nu este în măsură să funcționeze de la sine fără implicarea potențialului uman, intelectui și mobilizării. Dacă într-adevăr se dorește să se transfere către un model social atunci instituțiile de stat și structurile ar trebui să implice și eforturile cetățenilor în procesul de luare a deciziilor locale. În ultimul timp problema societăţii civile revine în actualitate şi e discutată activ în societatea noastră. Se expun diferite puncte de vedere asupra apariţiei societăţii civice, perioadelor sale istorice şi raportului ei cu statul.

Текущие преобразования в странах Восточной Европы и Республики Молдова предусматривают формирование правового государство и гражданского общества. Это сложный и операционный процесс функционирования социальной системы с демократической ориентацией. Успешное протекание этого процесса во многом зависит от тщательного исследования феномена «гражданское общество», который так и не был исследован социологами из бывших социалистических стран. Исторический опыт показывает, что ни одна модель гражданского общества не способна функционировать сама по себе без участия потенциального интеллекта и мобилизации человека. Если действительно есть стремление перейти к социальной модели, тогда государственные и общественные структуры должны сосредоточить все свои усилия на привлечении граждан в процесс принятия решений на местном уровне. В последнее время проблема гражданского общества очень актуальна и часто дискутируется в нашем обществе. Рассматриваются разные взгляды на возникновение гражданского общества, на историю его возникновения и его отношения с государством. В этой статье мы предлагаем проанализировать процесс формирования и развития гражданского общества в Республике Молдова, его правовую базу, лежащую в основе демократических преобразований.

The ongoing transformations both in Eastern European countries and in the Republic of Moldova involve the formation of the rule of law and civil society institutions. This is a process of learning the social system modernization with democratic orientation. Successful construction of this process depends largely on researching the phenomenon of „civil society”, which was less tackled by social scientists in the former socialist countries. The historical experience shows that no civil society model is able to function by itself without the realization of human potential, intellect and mobilization. If it is really desired to shift towards a social model the state apparatus and its structures should involve citizens’ efforts to make local decisions. Lately the issue of civil society institutions in former socialist countries became actively discussed and scientists tried to analyze emergence, historical periods and the relation of civil society with state. In this article we propose to analyze the process of affirmation and development of civil society in Moldova, and the legal framework that stands on the basis of democratic transformations.
