<description xml:lang='en' descriptionType='Abstract'>In the article the legal enforcement of maternity protection according to the labour legislation of Ukraine is being analyzed. Expediency of defining an independent complex institute of family, childhood, maternity and paternity protection in the system of national law is grounded in the article. Norms of labour law on maternity protection are studied as an element of legislative and other normative-legal acts, that in summation form a complex interbranch legislation in the sphere of family, childhood, maternity and paternity protection. The definition of maternity protection by the norms of labour law in provided. Correlation of terms “maternity security” and “maternity protection” is studied in the article. Proposals on improvement of current legislation and Draft Labour Code in the sphere of maternity protection are introduced.</description>
<description xml:lang='ru' descriptionType='Abstract'>В статье анализируется юридическое обеспечение охраны материнства по трудовому законодательству Украины. Обосновывается целесообразность выделения в системе национального права самостоятельного комплексного института охраны семьи, детства, материнства и отцовства. Нормы трудового права по охране материнства рассматриваются как составная часть законодательных и других нормативно-правовых актов, которые в совокупности образуют комплексное межотраслевое законодательство в сфере охраны семьи, детства, материнства и отцовства. Определяется понятие охраны материнства нормами трудового права. Рассматривается соотношение понятий «охрана материнства» и «защита материнства». Вносятся предложения по совершенствованию действующего трудового законодательства и проекта Трудового кодекса Украины в сфере охраны материнства.</description>
