Rezumat | ||||||
The question about the legal nature of a contract as a specific form of employment agreement as well as expedience of its use in view of accrual of nontypical work status has been considered. It is proved that the conclusion of the contract should be directed to ensuring conditions of initiative display and self-dependence of employee, taking into account his individual abilities and skills, increase of cross liability of the parties, legal and social security of employees. Comparative analysis between the contract and the
collective as well as the labour agreements are examined. It appears that it is useful to extend the sphere of the contract on atypical labour legal relations and to legislate the possibility of contract conclusion with atypical employees. |
