In the article on the right to strike and the mechanism for its enforcement contained in the Charter of the European Community of the Fundamental Social Rights of Workers (1989). Based on their analysis defines the possible limitations and restrictions of the
right to strike, as well as gaps in monitoring its implementation. The analysis is applied in comparison with those of the European Social Charter (1961) and its revision in 1996. In the article, in particular, it is noted that the Charter Communities almost
completely reproduces the position of the right to strike by the ESC, but in most respects it worsens. It concerns the place of the right to strike, among other trade union rights of formula a legal footing, a mechanism for settling labor disputes, limitations on the right for certain categories of workers. Negative aspects of a legally enforceable right to strike is amplified inefficient mechanism for its enforcement and optional, declarative nature
of the document itself. |
