This article is a comprehensive analysis of United Nations activities in the field of environmental protection in armed conflict. This problem is of great interest given that the multitude of conflicts which break out around the world increases significantly, while the environment is in a disastrous state because of many other negative factors, the United Nations being one of the few organizations that, at a global scale, can influence and change the situation for the better. Acting in this field, UN already has a significant role. Above all, the organization exercises a number of functions in this area, such as the research function, the function of information exchange, function of regulation and the function of monitoring and evaluating the state of the environment. UN bodies that are involved in this activity are primarily the General Assembly, which made its contribution adopting resolutions, as well as binding legal acts on the subject, and the Security Council, which in the case of the Gulf War proved that those who resort to force and degrade the environment, without taking the consequences into account, hold liability for their actions. ICJ contribution must be appreciated at its right value as well, the jurisprudence in this area being of course scarce, but very important for further development of legislation. A lot of other UN bodies are concerned about this issue, but the most significant is the United Nations Environment Programme with its Disasters and Conflicts sub-programme, dealing mainly with this problem. The study also highlights the weak points of UN activity related to environmental protection in armed conflicts and suggests solutions for making it more efficient, such as raising public awareness regarding the effects of war on the environment, improving the legal framework, developing the existing legal mechanisms for holding those who committed crimes against the environment responsible, and increasing collaboration in this field with other subjects of international law in order to achieve tangible results which are so necessary for the future of mankind in general. |
