This paper provides a brief overview of Romania's policy in the field of protection of national minority rights. The presence of this category of people in Romania is a certainty since the first censuses. The problem of national minorities became an important issue especially after the First World War, along with the creation of new national states, including Romania. Romania's position in relation to minorities was determined both by their history and developments that have taken place in this field in Europe. After achieving a comparative analysis of protection of national minorities’ rights in Romania’s Constitutions, we found it necessary to reflect the current legal framework. In this regard, we note that internationally, Romania has signed and ratified important documents in the field of minority rights and complied with respective provisions required thereby. Most of these were already translated into national law. We then analyzed the draft law on minorities’ status in Romania and debates arising under it, focusing on comments made by the Venice Commission. In conclusion, we formulated some proposals for lege ferenda in terms of improving protection of rights of national minorities in Romania. |
