Human trafficking is a crime of an international character, which take place around the world. Analysis of the above offenses, including qualifying signs, presents a scientific interest for the criminal law theory and its practical application. Relevance of the theme is also caused by the need to analyze the complex rules of international criminal practices which combat this social phenomenon. The effectiveness of combating this phenomenon in modern conditions depends not only on the law enforcement competence,
but also on the availability of the criminal law. Analysis of the criminal law provisions on trafficking in human beings shows that they are still far from perfect. This substantially complicates the enforcement activities. Also, it does not contribute to the uniform application of the criminal law, since analyzed norms in several cases admit dual interpretation. In this regard becomes necessary to develop
recommendations for improving these norms in order to enhance the effectiveness of combating human trafficking and slave labor. The norms of international law criminalizing these acts on human trafficking and forced labor were the subject of the present study. The objective of this article was to develop recommendations for the practical application and improvement of Russian criminal law norms related to the criminalization of human trafficking and the use of slave labor. |
