The property right appears as a subjective right that gives a legal form to the acquisition of a property item and permits a subject of law — a person — to possess, to use and to dispose of this item in a direct and straightforward way, with the help of his own resources and on his behalf, or indirectly, as an effect of proprietor’s evaluation of principal real property rights obtained over the object on the basis of and in accordance with legislation in force. In the context of these hypotheses, starting with the idea of certain new civil regulations, the author has laid down an aim of examining the characteristics and legal warranties of the property right.

Dreptul de proprietate apare ca acel drept subiectiv care dă formă juridică apropierii unui bun şi care permite subiectului de drept, persoanei să posede, să folosească şi să dispună de lucrul respectiv, fie direct şi nemijlocit prin putere proprie şi în interes propriu, fie indirect şi mijlocit ca efect al punerii în valoare de către titularii lor a drepturilor reale principale constituite asupra lui în cadrul şi cu respectarea legislaţiei în vigoare. În lumina acestor ipoteze, pornind de la ideea unor noi reglementări civile, mi‑am propus spre examinare caracterele şi garanţiile juridice ale dreptului de proprietate.
