Rezumat

In this study, there has been reached the conclusion that, in all the countries with an advanced market economy (USA,France, Germany, Spain etc.), there are penal settlements with regard to the limitation of free competition or of unfair competition. Typically, these criminal acts are punished through imprisonment and/or fine. In the foreign states, there is a strongly different manner of technical-legal approach to the settlement of the penal responsibility for offences in the competition field: in some countries, the respective norms are included in the Penal Code; in other countries, within some special laws containing penal provisions it is established the responsibility for the offences in the competition domain. It is argued that, in the context of receiving the other countries’ positive experience on the penal protection of competition, there must be implemented a more flexible approach on the problem of poly-normative assurance of the penal policy, being put first the fundamental values, including traditions, customs and the way of thinking characteristic to our nation.
