Rezumat

The victim’s consent is an institution of controversies and uncertainty, especially regarding its conceptual size and scope. Thus, the legal doctrine is rich in opinions regarding this issue; opinions that vary depending on periods, schools and law exponents. The main goal of this article is to popularize and and deepen the doctrinal concept of victim’s consent, without allegation of the idea of automatic acquisition of foreign logical constructions. Considering the current state of development of the society, we must recognize that the victim’s consent, as a penal matter, represents the expression of a valid decision of the person, considered to be holder of the social value; a decision that occurs between the mental attitude of the victim and the one of the perpetrator, thus permitting the last one to enact activities prohibited by the criminal law, thereby supporting the effect produced by the perpetrator’s conduct, regarded as a form of capitalization of civil rights on the one hand, and as a manifestation of the dispositive character of the criminal law on the other.
