This article comprehend’s other few arguments referent to the adoption of a new explanatory resolution of the Plenum of the Supreme Court of Republic of Moldova, regarding the judicial practice for penal cases related to sex offences. Particularly, there are pointed out solutions to overcome some controversial bearing, concerning the sex offences qualification, as well as it delimitation relative to other offences: the qualification of the coercion deed with a view to achieve the sex act, followed by the victim’s decease right ahead at the beginning of the sex act; the delimitation of human trafficking, perpetrated throughout rape (lett.g) par.(2) art.165 PC RM), incest (art.201 PC RM), infant trafficking, together with abuse and sex violence (lett.b) par.(2) art.206 PC RM), infant pornography (art.2081 PC RM), sexual harassment etc. regarding other offences referred to sex life etc. The article end’s with the presentation of the new explanatory resolution of the Plenum of the Supreme Court of the Republic of Moldova, regarding the judicial practice for penal cases related to sex offences. |
