In the framework of this article, it is performed the examination of some of the aspects of the offence of stealing the means of transportation subjective part. Especially, there are analyzed the subject and the aggravating circumstances of the offence. As well, there is defined the notion of „no intention of circumvention (evasion)”, prevented at art.1921 PC RM. Also are showed the circumstances that are able to demonstrate the presence of the mean of transportation intention of circumvention (evasion). It is argued that in case of same criminal intention, the intention of temporary usage of the mean of transportation turns into intention of circumvention (evasion). Respectively, the occurring becomes an evasion. Likewise are laid down the qualification praxis to the offence of stealing the mean of transportation, perpetrated in presence of aggravating circumstances. |
