Rezumat

The author of this article makes a theoretical analysis of the institution of civil servants, of the way of enlisting, his functions and his particularities. The given material examines the modifications that have touched the aggregate social and global systems of Republic of Moldova that is a transitional society to the democracy and to the fitting in europeen structures that didn’t let entouched bureaucratical system. A lot of documents were adopted nevertheless that settle the functionement of the administratif mechanism, their application in practice is hard. This thing is caused by two things. The first is our past and his stamps on nowadays bireaucracy, and the second some gaps in our low system that stimulate his activity. The control on the transformations of last years, including the conditions that determine the civil servants to unfold their activity, revel that these transformations remain to be formally and quantitatively. The substitution of the form not of the content that’s was conjugated by social- economical and social-political crises, have catalised the grouth of bureaucratical activity. Bureaucratic administrations is the dominant form of government organization in the contemporary world. It is employed not only in the public sector but also in such private sector areas as commerce, education, and religion. Whether states are democratic or authoritarian, they all employ some form of bureaucratic power. And yet, in contemporary societis bureaucracy is also highly criticized as bringing with it inefficiency, indifference, and red tape. The respective material has also a practical approche, it gives some recomandations and conclusions of forming a flexible, bureaucratic system. In this way public sphere of our Republic needs an Ethical Code for our civil servants, like a document to complet our legal system.
